ADVICE AND REPRESENTATION IN INSOLVENCY PROCESSES OF NATURAL PERSONS

DEBTOR OR GUARANTOR NATURAL PERSON REQUIREMENTS:

That does not have merchant quality.
That has two (2) or more obligations in favor of two (2) or more creditors for more than ninety (90) days or;
That two (2) or more executive proceedings or coercive jurisdiction proceedings are filed against them.
It is essential that overdue credits correspond to at least 50% of the total owed.

It is intended that debtors or guarantors can negotiate their debts, through an agreement with their creditors and thus normalize their credit relationships.

EFFECTS:

No new executive processes, restitution of goods due to default in rental fees or coercive jurisdiction may be initiated and the processes that have already been initiated will be suspended.
The provision of residential public services will not be suspended due to delay.
